Today, May 2, 2024, the financial administration must have the tax returns for the year 2023 in electronic form with them. However, it is still possible to use a few days for good without facing a penalty.
According to § 250 of the Tax Code you can file your tax return without penalty a full 5 business days later. This year, until Friday 10 May 2024.
The tax code states: A tax subject is obliged to pay a fine if he fails to submit a tax return or an additional tax return, although he had this obligation, or if he does so after deadline, and this delay is longer than 5 working days.
The amount of the fine according to the tax code is:
- a) 0.05% of the set tax for each subsequent day of delay, but no more than 5% of the set tax,
- b) 0.05% of the specified tax deduction for each subsequent day of delay, but no more than 5% of the specified tax deduction, or
- c) 0.01% of the determined tax loss for each subsequent day of delay, but no more than 5% of the determined tax loss.
The tolerance period also applies to the payment of tax
The same is true in the case of paying tax. Even here, it is possible to be late without the taxpayer having to worry about being penalized. The tax is due within the deadlines for submitting the tax return, i.e. for the electronic tax return, May 2, 2024. If the tax is paid after May 2, 2024, but no later than May 10, 2024, it is a late payment, but still there are no penalties.
