The UN Commission of Inquiry on Ukraine stated that war crimes were committed in Ukraine after the Russian invasion. Children were also raped, tortured and illegally detained. The commission will also look into allegations of forced transports and adoptions of children. During the oral presentation of the first conclusions of the commission, its chairman Erik Möse informed about this on Friday.

The Norwegian, who previously chaired the UN war crimes tribunal in Rwanda, also spoke of cases in which “children were raped, tortured and illegally detained” in Ukraine.

Möse emphasized that the commission is independent and impartial in its work. He also cited two cases of mistreatment of Russian soldiers.

Russia did not participate in Friday’s meeting of the UN Human Rights Council. He refuses to cooperate with the commission of inquiry, which was established in March.

Friday’s preliminary oral report was based on investigations in Kyiv, Chernihiv, Kharkiv and Sumy, where commission representatives visited a total of 27 locations and spoke to more than 150 victims and witnesses.

Investigators found evidence of a large number of executions, including bodies with their hands tied, throats slit and heads shot through, Möse said. According to him, the investigators also identified victims of sexual violence between the ages of four and 82. Although some Russian soldiers used sexual violence as a strategy, the commission said it did not find a “general pattern” of such behavior.

The UN commission also intends to investigate the mass grave near Izjum, where hundreds of bodies have been found in recent weeks. “It is of course a new event, but we definitely want to look at the Izjum case as well,” said Möse at the press briefing.

Asked whether crimes against humanity had been committed, Möse said the commission had not yet reached such a conclusion, citing a lack of evidence and analysis.

The commission of inquiry will now turn its attention to claims of the existence of “filter” camps in Russian-occupied areas for Ukrainian prisoners, as well as claims of forced transports of people and adoptions of Ukrainian children in Russia.

Reuters noted that investigations initiated by the Human Rights Council can sometimes be used before national and international courts. In Germany, for example, a former Syrian intelligence officer was convicted of state-sponsored torture in January.

Möse confirmed that he is in contact with the International Criminal Court (ICC). The Commission of Inquiry is due to submit a full report of its findings to the UN Human Rights Council at the end of its mandate in March 2023, including recommendations on how to hold perpetrators accountable.
