According to the file, the injured Roman Polák insulted his girlfriend on Mendlová náměstí last September for making out with others, after which he threw her off the bench and poured beer over her. This did not sit well with Kaniak, who was lent a knife by another man he was drinking with, thinking he needed it for his meal. However, he attacked the Pole with it.

“During the short time I was on Mendlák, I saw her beat her several times,” Kaniak said in court, adding that when his wife threw him out on the street, he began to turn to alcohol more. Claims regarding the Pole’s rudeness towards his partner were also supported by other witness statements.

According to him, it bothered the Pole that his girlfriend was drinking with homeless people. “I came there to pick her up and wanted her to go home. She wasn’t supposed to drink, she was in treatment, but they pulled her over every time and lured her to booze. We only argued because she was meeting with them,” said the injured party, who was measured at the hospital with a blood alcohol level of 2.24 per thousand.

According to public prosecutor Milan Richter, Kaniak deliberately and deliberately came to the sitting Pole with a borrowed knife and stabbed him in the left part of the neck. He then stabbed him again in the neck and, after the conflict escalated, also stabbed him three times in the abdomen and once in the back.

He doesn’t really remember the attack

The Pole’s injuries were so serious that if the doctors had not helped him in time, he would not have survived. “Two wounds penetrated the liver, this injury was accompanied by significant bleeding into the abdominal cavity. He lost 2.5 liters of blood,” explained forensic doctor Jan Krejza. A wound to the neck that penetrated to the larynx could also be fatal, and as a result of the swelling, the victim would suffocate without help.

Kaniak remembers the incident only very vaguely, his blood alcohol level was measured at 2.02 per thousand after his arrest. “The whole time I’m locked up I’m trying to remember exactly what happened. I saw the film footage, so I know that I did it, and I’m not going to question it in any way,” said the defendant, saying that he regrets his act and never intended to endanger the Pole’s life.

However, this was disputed by the plaintiff. “If someone repeatedly attacks the neck or abdomen with a stabbing mechanism, I believe that they must act with an understanding of the consequences this action can lead to,” Richter pointed out in his closing speech. According to psychiatrist Marta Holanová, Kaniak acted in an affect.

Although, according to judge Dušan Beránek, the defendant apparently did try to defend the attacked woman, it was not a necessary defense in this case. “He has a tendency to commit criminal activity not only in our country, but also in his native Slovakia, where he has been convicted several times. That’s why we consider half of the penalty rate to be a fair punishment,” announced Beránek. Both sides kept the appeal deadline.
