The witness before the court described at length her complicated relationship with the Italian father of the child. She testified confusedly, some sentences did not make sense.

“Further, there were some problems with him,” she said to Itala, saying that the boy’s father had an explosive temper and often behaved violently towards her.

Conflict over trifles

Before the tragedy, the Italian father came to pick up his son to spend time with him. The woman, who moved out of the apartment in Mostec with her children before the man’s arrival from Italy and wanted to continue living with Pokuta, stated that she – accompanied by two other children – met the Italian, her son and Pokuta by chance at the elementary school in Rozmárýnova Street. She then started arguing with the Italian over trivialities.

According to her, the 32-year-old Pokuta initially did not want to interfere in the conflict. It is said that the little son was calling her, the father was shouting. Subsequently, the Italian began to chase the Penalty with a stick that he pulled out from the fence. He then returned to the woman and grabbed her by the neck.

“Michal then ran away, he wasn’t there for some time,” the woman recounted. Subsequently, she described that the Italian allegedly threw her to the ground. When Pokuta returned, the father took his son in his arms and again the stake.

“I wanted to take at least the stake from him, he was ready to hit Michal. He pushed me away, I fell and then it happened when I was on the ground,” she said, adding that she did not see the stabbing itself.

Judge Martin Parolek objected that in the preliminary proceedings to the police the woman testified that she saw the attack by the defendant and that the Italian allegedly took her son as a shield. The witness could not explain the discrepancy in her statements.

According to the indictment, during the ongoing argument, Pokuta quickly ran up to the Italian, who was holding his son’s chest with both hands, and lunged with his left hand, clutching a knife. It happened at the moment when the man with his son in his arms started to turn towards him. The blow hit a small child. The expert had previously stated that the blade had stopped on the bone between the spine and the skull, an artery and a vein had been severed and the boy had no chance of survival.

The child’s mother repeatedly stated in court that Pokuta liked her son. “He never hurt him,” she claimed in court. On the contrary, she described the relationship with the father of the joint child as bad.

“He annoyed us, threatened us, got into us, embarrassed us,” she said of the Italian, whom her son reportedly called Bubu. “It’s like he’s a bum,” explained the witness, who is not demanding non-pecuniary compensation from Pokuta.

Under the influence of drugs

According to experts, the defendant does not suffer from a mental illness, but he is said to have a reduced intellect and a mixed personality disorder with a tendency to addictive behavior. They characterized his actions on that day as an affective short-cut reaction in an aggravated relationship conflict at a time when he was under the influence of drugs – methamphetamine and marijuana. According to experts, intoxication at the time of the crime was not so fundamental as to influence the actions. But drugs played an accelerating role.

“The defendant did not take the child into account, he threatened to kill him, after returning he continued with a gun in his hand,” said expert Jiří Klose. According to him, Pokuta had time to think everything over before returning to the place.

The man later sincerely regretted his act. “I do not agree with the opinions of psychology and psychiatry. I returned to the scene because (the Italian) continued to attack my wife,” explained the decision of Fine, who faces up to 20 years behind bars.

The trial will continue in April with the questioning of the child’s father.
