A barbaric practice from the past, politicians welcome the verdict on castration during sex change. The people are not happy

“The Constitutional Court ruled in favor of human dignity. I am very happy about this, the abolition of the condition of surgical intervention including sterilization during official sex change is something that I have supported and advocated for a long time. It does not belong to the Europe of the 21st century,” stated Minister of the Interior Vít Rakušan (STAN).

There is also joy in the Pirates club. “It was a barbaric practice that belongs somewhere in the past. The state should not interfere in people’s lives more than necessary. For people to dictate who can and cannot have the possibility of reproduction is unacceptable,” said the pirate MP Klára Kocmanová.

However, their colleagues from ODS and KDU-ČSL are a little less enthusiastic. “I’m not happy, it’s exactly a matter in which, according to my view of the world, the Constitutional Court should not interfere. But no doubt we will have to deal with it somehow. The coalition has already considered the relevant amendment, but no conclusions have been reached yet,” the chairman of the ODS club and deputy chairman of the constitutional and legal committee of the House of Representatives, Marek Benda, told News and Rights.

Even the chairman of the People’s Deputies and vice-chairman of the constitutional-legal committee Aleš Dufka does not like the court’s decision. “As MPs, we have to deal with it somehow. But I don’t know what will come next. I can say for myself that I respect the opinion of the Constitutional Court, but I wonder what priorities it came from,” he noted.

However, Dufek does not want to vote for people to be able to officially change their gender just by deciding what gender they feel like.

Blažek is preparing the law

Prime Minister Petr Fiala (ODS) also respects the decision of the ÚS. It is said that the government will soon respond to it by changing the Civil Code. “The Ministry of Justice has prepared the law and will submit it to the government as soon as possible,” said Prime Minister’s spokeswoman Lucie Ješátková for Právo a Novinky.

ODS vice-president Eva Decroix mentioned that the finding will be taken into account in the discussion about the new law.

Minister of Justice Pavel Blažek (ODS) stated that the appropriate amendment of the law in the paragraph wording has been prepared at the ministry for two years. “However, there was no political agreement on whether and when to submit the bill to the government,” he mentioned.

The topic will also be discussed in the ANO parliamentary club. Their former Minister of Justice, Taťána Malá, understands the decision of the Constitutional Court, because according to her, the current situation did not make sense. “It used to be that a person had to undergo castration or sterilization, he was not allowed to be fertile. But his genitals could remain,” she told Novinkám a Práv.

“I know that trans people often did not want to undergo sterilization and castration because they were afraid of the risks. Especially for women, incontinence and similar problems often occur after sterilization,” she mentioned. They have no idea what solution the politicians should come up with now.

Effective from mid-2025, the Constitutional Court canceled the disputed sections of the Civil Code. Politicians must accept the new arrangement. The judges thus accepted the complaint of a trans man who, even without surgical intervention, demanded an official gender change from female to male.
