“No one ever has the right to take a person’s life, especially not in such a cruel way,” said the president of the senate, Jana Bodečková, in the justification of the judgment.

The judgment is non-binding, the public prosecutor kept the deadline for appeal, Baráková appealed.

“Damn it, how can I be convicted of something I didn’t do. I’m not a murderer, I didn’t kill anyone,” Kučera started shouting in the courtroom after the verdict was handed down.

He complained in an indiscriminate manner that the police had not properly investigated the case. Because of his unmanageable behavior, the prison service had to intervene.

“The guard pushed his head between his legs and waited for him to calm down, it took a few seconds,” the editor of MF DNES reported from the courtroom.

The public prosecutor originally proposed a life sentence for Kučer. According to Judge Bodečková, this punishment can be imposed for a particularly reprehensible act, which this case fulfills. “But the court found that it was impossible for the offender not to correct himself with the punishment. The twenty-five year sentence is also an exceptional sentence, as the original sentence is 15 to 20 years. The conditions for granting a life sentence are very strict and the court did not find them here,” she added.

The court also found Kučera guilty of illegal arming.

According to the file, the defendants murdered the elderly woman for property. Long-term strained relations culminated in an argument in the family home in Libišany in 2022, forty-six-year-old Kučera intervened in the conflict between forty-three-year-old Baráková and her mother.

He took a heavy vase and started hitting the victim on the head while sitting on her back on the ground. The attack then culminated in Kučera taking a drill and using two drills with a diameter of six and eight millimeters to drill five holes in the right ear and the right side of the neck of the helpless elderly woman. The victim had no chance of surviving this attack.

The two defendants then covered the tracks together and poured acid over the victim’s body. They later called the police and claimed to have found the dead woman in the house.

State attorney Lenka Faltusová proposed a life sentence for Kučer, also due to the fact that he had been convicted several times in the past and had never learned from his punishment. “His level of harm to society is high. The conditions for life imprisonment are met,” she said, adding that resocialization is possible for Baráková.

“She is also facing an exceptional sentence, but the conditions for it are not met. Not only because she led a decent life before committing the crime. She confessed and helped the police clarify the case,” noted Faltusová in the proposal.

According to her, the defendants had no respect for human life. “They selfishly wanted to satisfy only their needs, and the injured party experienced extreme physical and mental suffering. As part of covering up their tracks, they acted rationally and appropriated the damaged personal belongings,” the public prosecutor recalled.
