On Thursday, the Prague Municipal Court imposed an eight-year prison sentence on the manager of the bankrupt German company Viktoriagruppe Petar Malá in the case of the missing Czech diesel fuel. At the same time, he was banned from managing companies and protecting state reserves for ten years. According to the non-judicial verdict, he defrauded the State Material Reserves Administration (SSHR) of at least 108 million crowns.

The court acquitted three managers of the company’s Czech branch. The Viktoriagruppe itself also faced charges, the court found it guilty and imposed a ten-year ban on its activities in the protection of state reserves.
The municipal court heard the case for the second time. Last year, he found Malé, Viktoriagruppe and one of the employees of the spin-off plant located in Dolní Břežany, Lubomír Novotné, guilty. He freed Jaroslav Slavík and Miroslav Holub.

This judgment, which sentenced the executive to seven years in prison and a fine of ten million, was subsequently overturned by the Prague High Court of Appeal.
“We consider the amount of damage to be an aggravating circumstance, which many times exceeds the threshold for damage of a large scale,” said Senate President Jarmila Pavlátová.
Although, according to her, Malý obtained considerable money from criminal activities, he has now given the court sworn statements that he has no movable or immovable property. The court therefore increased the man’s prison sentence and did not impose a monetary penalty on him.
The court added some evidence in the second round of the case, but according to the judge, the situation in Malé’s case has not changed. According to her, his guilt was proven.

SSHR paid Viktoriagruppe a fee for the storage of Czech diesel, the amount of which depended on the amount of fuel stored. Viktoriagruppe, on the other hand, was to pay a fine if it did not manage to store the agreed amount of diesel on time.
According to the verdict, the company actually did not make it and decided to cover it up by fictitiously increasing diesel stocks with two false receipts sent to SSHR for reimbursement. In addition, from November 2012 to January 2013, the defendants allegedly removed three train sets of diesel for which SSHR was not reimbursed.
When Viktoriagruppe ended up insolvent in 2015, a legal battle began over the stored stock. In the end, after negotiations with the bankruptcy administrator, the Czech Republic gradually managed to move the diesel back from the Bavarian Krailling.
However, after the last tanker arrived from Germany, the measurement confirmed fears that some of the fuel was missing. SSHR was short of 6.3 million liters of fuel. The administration was in dispute with the insolvency administrator about the ownership of the diesel fuel. The District Court for Prague 5 ruled without jurisdiction in April that the fuel belongs to SSHR.
