According to Novinek’s findings, Grisník has been an employee of the municipality again since May of this year. He joined the Technical Office in a position where a clean criminal record is not a requirement. He has a one-year contract and his job is once again investments.

“Its acceptance does not contradict any legal regulation. He is not in a clerical position or in another job position for which the law strictly requires criminal integrity,” said office secretary Václav Váchal.

“He fulfills tasks related to the issue of investments, which he understands very well. These are analyzes or preparation of documents. He has no decision-making authority,” added Váchal.

According to him, this is a temporary solution with regard to the desperate personnel situation at the investment department.

“I know it’s not the happiest solution. I also carefully considered the moral responsibility, but due to staffing shortages, I had little choice to ensure the running of this agenda at all,” the secretary explained.

The Technical Office belongs to Deputy Mayor Pavel Bosák (Pirates). In response to Grisník’s return, he said that it happened based on the decision of the office with personnel authority.

“He has every right to do that, and if everything is in accordance with the law, it would be inappropriate for me as a politician to interfere in any way.” If something is legal, I can’t say that I don’t like the person and that I will forbid him to be employed. That would be illegal,” said Bosák.

However, the mayor of the city, Roman Zarzycký (ANO), has a different opinion. “Even if there is no violation of the law in the case of hiring Mr. Grisník, I do not consider such a decision to be correct given the circumstances,” the mayor said.

Grisník took up an important official post in Pilsen in 2015. Shortly after taking office, the police charged him on the suspicion that in 2012, at his previous workplace, as the head of the construction office in Aš, he sanctioned the construction of wind farms in violation of the law by a private company.

In 2022, the Chebský court sentenced Grisník to a two-year prison sentence, suspended for two years, for abuse of the authority of an official.

The regional court later confirmed the original guilty verdict on appeal, only reducing the sentence with regard to the time that had passed since the crime was committed.

“He intentionally, long-term and comprehensively helped a private company to successfully complete the construction procedure in a situation where the law was being circumvented or violated,” stated Cheb judge Jan Polák at the time.

He should have prevented construction, not legalized it

According to the file, Grisník first agreed to start work on the construction of two wind farms in places other than where they were approved as part of the zoning and building management.

“After the completion of the construction of both power plants, he allowed trial operation in violation of the law, although he knew at the time of the decision that the constructions were not carried out in accordance with the project documentation, zoning decision and building permit,” reads the judgment of the Cheb court.

“Thus, he enabled the company APB Plzeň to supply electricity to the distribution system, thereby providing it with an unjustified benefit,” reads the judgment, which is available to Novinky.

According to the court, in a situation where Grisník knew that the buildings were not being implemented in accordance with the documentation, he definitely should not have allowed the test run, but should have warned the builder about the errors and demanded correction.

Instead, he took steps to help the company legalize wind turbines built in violation of the issued permit.

Compared to the original project, the APB company requested to place the wind facilities at a different location, but encountered a negative opinion from the Department of the Environment.

He relied on an expert’s opinion, according to which the building in the newly requested location would have a negative effect on the landscape. Nevertheless, the company eventually built the windmills there.

“The defendant was heavily involved in the case. He spoke with the builder’s representatives several times a day and advised them how to proceed and what documents to submit. He tried to help them reverse the negative opinion of the Department of the Environment, which he also inappropriately and uncollegiately commented on in front of them,” wrote the judge in the justification of the verdict.

“Together with the secretary of the town hall, they agreed on how to achieve the exclusion of the official in question from decision-making, that pressure should be aimed at her from the other side as well, and that she would eventually succumb,” added the judge.

He met the builder sideways

The court also drew attention to the fact that Grisník met with representatives of the builder outside the office building.

“The defendant’s relationship to the case can be seen from the wiretap, where he informs the builder that he has already spoken to everyone ‘who does not want us,'” the court added, stating that the defendant’s behavior certainly cannot be characterized as the standard behavior of an official of territorial self-governing units .

“The defendant did not only act dispassionately, but contrary to the performance of the function and the position of the official,” the court concluded.
