Leitman Bailey has a tarnished reputation in New York and had his law license suspended for four months in 2019 for “advising” a client to “commit suicide.” The controversial lawyer has now sparked a state investigation after he said he communicated with Manhattan Supreme Court Justice Arthur Engoron three weeks before that judge issued a $455 million judgment against Trump in February.

“I spoke to him three weeks before. I saw him in the corner of the courthouse and I came up to him and we started talking… I wanted him to know what I was thinking and why… I really want him to make it right,” Bailey said, according to the New York Post.

That conversation prompted an investigation by the State Commission on Judicial Conduct. The judge cannot communicate about cases without the presence of all parties in the matter. Under the state’s rules of judicial conduct, a judge can “obtain the advice of an impartial expert” if the parties are given advance notice and an opportunity to respond.

Bailey said he gave Engoron his views on the fraud law that is at the center of New York Attorney General Letitia James’ lawsuit against Trump. The real estate attorney says he “explained” to the judge that he did not believe the law could be used in the Trump Organization’s case.

“He had a lot of questions, you know, about certain cases. We came through,” he said of Engoron.


But state courts spokesman Al Baker denied to NBC, that Engoron and Bailey would talk about the case. “There was no ex parte conversation between Judge Engoron and Mr. Bailey or any other person regarding this matter,” Baker said in a statement. “The decision that Justice Engoron made on February 16 was his alone, deeply considered and completely uninfluenced by this person,” the spokesman added.

Robert Tembeckjian of the State Commission on Judicial Conduct declined to comment on the situation. “The SCJC is bound by a strict confidentiality statute and cannot comment on this matter,” Tembeckjian said.

The controversial lawyer is not connected to any of the cases currently surrounding ex-President Trump, but has given several interviews to various media outlets in which he offered legal commentary regarding Engoron’s decision.

Bailey has admitted in a series of other interviews that he does not support Trump and said he has sued the real estate mogul in the past. In subsequent interviews, he explained that Trump’s name was not mentioned in the conversation with the judge and that they only talked about the law in general.

“We didn’t even mention the word Donald Trump,” Bailey now claims. “Well, of course we weren’t talking about the Mets,” he added, apparently implying that he thought Engoron knew what they were talking about. But Bailey says neither of them broke any rules.

Trump and his lawyers said they plan to appeal Engoron’s decision. Additionally, Trump’s attorney Chris Kise said that if it is true that Engoron discussed the case with Bailey, “it would call into question the integrity of the entire case and further undermine public confidence in a New York legal system that is already the subject of international ridicule.”

Kise also said that if the allegations are true, he believes the judge may have had such conversations more than once. Trump’s legal team is therefore calling for Judge Engoron’s resignation and demanding a review of all of the judge’s email and cell phone communications and all communications of everyone else involved in the case.

“If this is true, there is simply no reason to believe that this was an isolated incident. Any judge willing to engage in such an exchange of views and willing to simply ignore clear rules of conduct would likely do so repeatedly over the long course of the case,” Trump’s lawyer said.
