The embezzlement case of 46 million crowns in the Czech municipality of Sokolská (ČOS) continues. The Sokolovs read out of the loan agreements that they were digitally signed by both former members of the association’s statutes – mayor Hana Moučková and executive Josef Těšitel. How they got their signature on the contracts is under investigation. But the new management of Sokol announced that they would demand compensation from both of them. “I have already informed them about it,” said the new mayor, Martin Chlumský.

“We found out some things that emerged from the contractual documentation with the bank,” said the newly elected mayor of the Czech municipality of Sokolské (ČOS), Martin Chlumský, when asked by the iROZHLAS.cz server about the progress in his own search for the Sokols.

As we previously reported, the Sokols obtained documentation from Komerční banka regarding the concluded loan agreements, thanks to which Eliška C. – the assistant of former mayor Hana Moučková – embezzled 36 million crowns from the loans provided, according to the investigation so far. Another ten million was then to be withdrawn directly from the Sokol bank accounts.

After the police became interested in the case, according to the management of Sokol, the assistant committed suicide.

“A very fundamental finding is that the loan agreements that were concluded were signed digitally using the bank identity of both former statutory representatives,” Chlumský added, referring to ex-mayor Hana Moučková and former executive Josef Těšitel. According to the management of Sokol, how they got their signature on the contracts is the subject of an investigation.

Where did the money go?

According to the authorized head of the Česká obce Sokolská (ČOS), vice-chairman Martin Chlumský, the stolen money does not come from any subsidies. According to the investigation of falcons to date, there are three sources:

  • Credit and overdraft agreements: assistant Eliška C. was to receive the largest part of the money from three concluded loan agreements in the total value of 36 million crowns, including interest
  • Down payment for renting Tyrš’s house:Eliška C. also withdrew approximately 3.5 million crowns from the account on which the principal for the rent of Tyrš’s house was located
  • Budget reserve: the assistant also stole the last approximately 6 million crowns from the account where the ČOS had a budget reserve

According to Chlumský, Sokol has already prepared a legal analysis of how he will proceed in the matter. According to the new mayor, the contracts were not concluded in a standard way – he did not elaborate on what this means exactly.

But the Falcons will try to get the money back. “We will have to recover compensation for the damage that they have caused us (Moučkov and Těšitel, editor’s note) was created,” he emphasized.

Deputy mayor Kamila Šrolerová added that the Falcons plan to recover the damage in civil proceedings. The village management has already informed Moučková and Těšitele about their intention. “They are counting on this possibility. It is a standard thing in federal law,” confirmed Chlumský.

The Sokolovs have also applied for the inheritance proceedings after the deceased assistant. The police seized part of her property, and police spokesman Jan Daněk said that if it is proven that the property comes from criminal activity, the proceeds from its sale can be used to pay for damages.

“We are also preparing for that and analyzing it. But it is not yet clear what belongs to the estate of the late Eliška C., so before we take further steps, we must first wait for concrete information,” added Deputy Mayor Šrolerová.

We will not sell the property

According to the management of Sokol, the assistant of the former mayor Moučková should have concluded contracts without the knowledge of the management of the association – two loan contracts for 15 and 12 million crowns and one overdraft contract for 5 million crowns. In total, including interest, it is 36 million crowns, which form the basis of the embezzled money.

Since they were digitally signed by the statutory members of the association as stated in the statutes of the municipality of Sokol, the contracts are valid according to the bank. Sokol must pay them back.

Repayment of the twelve million dollar loan and the overdraft agreement is already expected this year. As the management of the organization announced shortly after the approval of the budget for this year, Sokol is counting on savings and cuts to create a reserve for repaying the twelve million dollar loan.

“We approached the budget in such a way that the activities of the counties and units were minimally affected,” assured the head of the budget commission, Martin Vlk.

The Falcons want to spread the second loan agreement for 15 million crowns over time through an installment plan. “We are discussing this with the bank,” Chlumský added.

The Sokolovs have also previously denied that they would sell the property. “We certainly do not intend to sell property in connection with this case. I do not rule out that we could rent part of the property in the future, but it would not be a consequence of this case,” Chlumský added earlier for iROZHLAS.cz and Radiožurnál.

More than two months have passed since the beginning of the fraud investigation in the Czech municipality of Sokolská, when the mayor’s assistant took 46 million crowns out of the association. The police investigation is still ongoing, and criminal investigators do not want to comment on whether they suspect anyone else in the case besides the assistant. However, they have not yet ruled out the participation of possible accomplices.
