A collision with another vehicle is always unpleasant. But what if, in addition to all the inconveniences associated with the accident, it turns out that the person responsible for the accident does not have liability insurance? How to proceed in such a case?

Car insurance it is simply mandatory, without it you should not be allowed to drive the vehicle on the road at all. It serves to cover damages that you may cause in the event of an accident. However, if the other driver still does not have liability insurance, this can be a problem.

How to ideally proceed in every accident?

The first step is to stay calm. Try to speak calmly to the other driver, don’t blame him or threaten him, even if he doesn’t have insurance. For an easier agreement, it is definitely better if you avoid conflicts. It is also ideal to always have a form for recording a traffic accident in the car, then the whole process of investigation and reimbursement by the insurance company is much easier.

“In the event that the damage to the vehicles exceeds CZK 100,000, there is harm to the health or damage to the property of a third party, it is necessary to call the Police of the Czech Republic. The police record will be important evidence of the accident for the insurance company. Be sure to also write down the other driver’s contact information: name, address and phone number. This information will help you claim compensation. Once the situation is under control, contact your insurance company. They will give you information on how to proceed,” recommended by Martin Thienel from Kalkulátor.cz.

What is the best way to proceed if you have an accident with a driver who does not have compulsory insurance?

Fortunately, we have a Guarantee Fund established by the Czech Office of Insurers, to which insurance companies make payments. They mainly draw on contributions that are part of the payment of compulsory insurance. The guarantee fund can provide compensation for damage caused by uninsured cars. This means that even if the person responsible for the accident does not have liability insurance, you still have the opportunity to receive financial compensation for the damages caused.

“The Czech office of insurers will carry out the liquidation of the damage and payment in the same way as an insurance company would do in the case of an insured vehicle. If damage is caused by an uninsured vehicle, which the Czech office will have to compensate the injured party, it will recover it from the person responsible for the accident.” says Martin Thienel from Kalkulátor.cz and adds: “If you discover that the other driver does not have liability insurance, it is ideal to call the Police of the Czech Republic even if the damage is less than CZK 100,000.”

Complications can arise when the accident is caused by a vehicle, when the culprit drives away and remains unknown. In such a case, the Czech Office of Insurers will only pay for damage to health, not to the vehicle. So it is ideal in this case to take photos as soon as possible.
