In recent years, a number of regulations have been spewed at European citizens and companies from the European Union, which try to set strict rules even for sectors that are just in their infancy, and from Brussels is coming boasting that the EU “will be the first in the world to have comprehensive rules for the use of artificial intelligence” and echoing the staunch claim that regulation “benefits” innovation.

In March this year, the Council and Parliament reached an agreement to expand the use of digital tools in the area of ​​EU company law, and recently the digital services packages, whether it was the Digital Services Act or the Digital Markets Act, also came into force.

However, it does not end there. “The European Union is actively striving to improve the digital environment for the benefit of all Europeans. Our digital lives must be safe and easy and respect fundamental freedoms.” it sounded from Brussels, while the data act and the artificial intelligence act were also discussed there last year.

However, there are opinions that, while American companies can quickly adapt to such a large amount of legislation and “slide” between them, European ones end up overwhelmed by bureaucracy, according to study by law professor Ana Bradford however, Europe has major problems hidden elsewhere.

The study, highlighted by analyst Giorgos Verdi, points out that Europe was already in trouble at a time when European regulation in the field of technology did not exist. “However, for almost two decades, the European digital economy has not been regulated. And yet the EU has not been able to nurture companies like Microsoft or Apple,” Verdi summarized.

Bradford pointed out that while Americans have taken the approach of arguing that tighter regulation of the digital economy inevitably threatens innovation and undermines technological progress, the European Union has taken a different path and “regulates the digital economy with strict privacy regulations, antitrust regulations, content moderation regulations and more digital regulations that aim to shape the development of the technology economy towards European values ​​of digital rights and justice’.

However, according to her, the connection between digital regulation and technological progress is significantly more complex than the public discussion has so far believed, American legislators, technology companies and some scientists and the rise of the American technology business should have ignited completely different realities that the EU has not yet been able to imitate.

So what is behind Europe’s failure? Bradford immediately undermines the main pillar of the European Union when she claims that the single market “doesn’t exist”, but there are 27. “And it’s harder for innovators to scale when you have to deal with 27 cultures, 27 administrations and 24 official languages,” explains Verdi .

The single market is precisely what Brussels considers its greatest success. “The EU single market, which was established in 1993, is one of the greatest achievements of the European Union. It guarantees the free movement of goods, services, people and capital throughout the EU – the so-called ‘four freedoms’. It also allows EU citizens to live and work anywhere in the EU and provides them with better job opportunities.” it is written on the website of the Council of the EU.

The study also notes that while European tech start-ups typically rely on risk-averse banks for funding, US tech start-ups tend to rely on venture capital, and while the US regime allows for a fresh start if a project fails, European bankruptcy laws “tend to be merciless”, or immigration laws, which, according to Verdi, “drive away talent”. He pointed out that behind the significant success of American companies are people from India, Canada, Israel, the United Kingdom, China and several EU countries, including Germany, France and Ireland.
