The European Union approved the final version of the migration pact on Wednesday. Although the Czech Republic abstained from the final vote, the cabinet of Petr Fiala (ODS) defends its final form and considers it a balanced “European” way to solve the problem with the influx of migrants, the opposition does not spare criticism and talks about the fact that the pact is just another name for the previously much criticized migration quotas.

Although the Minister of the Interior Vít Rakušan (STAN) and the Minister of Foreign Affairs Jan Lipavský (Pirates) assure the public that the Czech Republic will succeed in negotiating an exemption from the need to accept illegal migrants on its territory or to pay a “ransom”, because in terms of population, the Czech Republic took care of the largest number of refugees from Ukraine. Robert Kotzian, a lawyer and candidate of the Liberals for the European Parliament, emphasizes that, regardless of political proclamations, the approved form of the migration pact actually contains mandatory quotas.

Kotzian’s criticism is directed in particular at the mandatory offsets, which determine the distribution of jurisdiction for handling asylum applications between member states. “These rules are crucial, but their interpretation remains controversial. While the Home Office claims that offsets only apply to migrants already present in a given state, I am concerned that they could lead to compulsory redistribution of migrants,” Robert Kotzian is convincedwho published a clear summary of the entire migration pact.

According to him, another factor is the influence of neighboring states on migration and the potential change in the situation in a given member state. “Even if the Czech Republic is not the primary destination of migrants, the dynamics of migration may change. This would have an impact on the application of mandatory offsets,” warns Kotzian, while also warning of the possibility that the EU Council may approve a higher number of mandatory relocations, which could lead to further tensions between member states. “There is a risk that the political activism of some states may lead to unfair agreements on the redistribution of migrants,” he adds.

At the end of his summary, Kotzian draws attention to the uncertainty of future developments and calls for caution. “While I fear that my warning may be unnecessary, I emphasize that even the remote possibility of mandatory redistribution is unacceptable given the seriousness of this issue.”

The Migration Pact thus becomes a key topic of discussion about the future of the European Union and its migration policy. While some emphasize the need for solidarity and a common approach, others warn of the risks and impacts of forced redistribution of migrants. What is certain is that this debate will continue, and its results will have long-term consequences for the whole of Europe.
