House Conference Chairwoman Elise Stefani will file an ethics complaint Tuesday against special counsel Jack Smith, whom she accuses of violating Justice Department standards and trying to sway the election against former President Trump.

In a letter to the Justice Department’s Office of Professional Responsibility, Stefani called on government watchdogs to investigate Smith over allegations he “misused federal government funds to illegally interfere in the 2024 presidential election.”

Smith’s actions, which Stefanikova sees as election interference, include multiple attempts by Jack Smith to speed up the trial in the Jan. 6 federal case against President Trump and violations of ethics and legal conduct. These moves are seen by Stefanikova as Jack Smith’s attempts to speed up the trial and legal maneuvers to influence the outcome of the 2024 presidential election.

“Jack Smith’s repeated attempts to expedite the trial in the January 6 federal case against President Trump violated long-standing and express DOJ policy. Further, Jack Smith’s repeated violations of the stay of proceedings by the United States District Court for the District of Columbia is an illegal violation of judicial ethics and legal conduct. “Jack Smith brought his actions into disrepute with the Department of Justice and the federal government as a whole and should be punished accordingly,” the company said in the letter. Fox NewsStefanikova.

Smith’s charge against Trump for tampering with the 2020 election remains unresolved as the Supreme Court considers Trump’s immunity challenge for acts committed during his presidency. The former prosecutor has repeatedly asked the court to reject Trump’s request and continue the trial, but the justices have yet to make a decision. Smith first filed the complaint against Trump in August 2023 and requested a trial in January 2024.

“There are approximately thirteen million pages of findings available to President Trump and thousands of hours of CCTV footage. “Prosecutors bringing such a complex case — with so many consequential and new legal issues to resolve — would never normally try to get it to trial within five months,” Stefanikova argued in the letter, saying the only reason for pursuing so The early deadline was an effort to try the case before the November presidential election, in which Trump is most likely to face current President Joe Biden.

“Jack Smith is trying to speed up the court process so he can influence the election in November,” Stefanikova said.

Stefanikova also sees Smith’s motivation to influence the election as his change of attitude towards certiorari – a judicial process whose goal is judicial review of a decision of a lower court or an administrative authority. He opposed it in February, despite having supported it two months earlier, without providing a clear explanation beyond a vague claim of an urgent interest in quickly resolving the case, suggesting a change in stance driven by electoral reasons.

According to Stefanikova, these irregularities and actions point to a pattern of Jack Smith’s behavior that is consistent with the goal of interfering in the November election through legal maneuvers and expedited court proceedings.

For another argument to open an ethics investigation of Jack Smith, she used his own words when he declared that “no one is above the law”.

“If that is true, then he should be open and welcome an ethics investigation into the conduct, which, based on its indications, involves potential violations of DOJ policy and numerous rules of professional conduct,” Stefanikova said.

“Therefore, your office should open an investigation into the apparent violation of DOJ standards and other ethical duties by Biden’s special counsel, Jack Smith, who is clearly seeking to politicize his criminal prosecution and illegally interfere in the 2024 presidential election,” the letter concluded with a greeting.

Tampering with evidence

Additionally, Jack Smith’s legal team on Friday openly admitted that key evidence in the criminal case against former President Donald Trump was altered or tampered with after it was seized by the FBI. Documents seized from Trump’s Mar-a-Lago mansion were rearranged, creating two different chronologies.

“In some boxes, the order of the items in that box is not the same as the related scans,” the plaintiffs wrote. Smith’s team also admitted in a footnote that it had misled the court when it previously said the evidence remained exactly as it was seized.

According to several legal experts for the server Just the News said it was essentially an admission of tampering with evidence.

“Prosecutors and investigators should never tamper with or change the evidence they have, including the order of the documents in the box, because you never know what may become relevant or crucial to a court or jury later in the case,” said the law professor at Harvard Alan Dershowitz.

In response to these confessions of Jack Smith’s team, Trump immediately demanded his arrest on the Truth social network. “ARREST MAD JACK SMITH. HE IS A CRIMINAL!” Trump fumed.

“It has always been clear that the ‘documents case’ is nothing more than an election fraud hoax concocted by crooked Joe Biden, deranged Jack Smith and their hacks and thugs. Now deranged Jack has admitted in a deposition before Judge Cannon to what I have been saying since the trespass at my Mar-a-Lago home in Palm Beach, Florida – that he and his team committed gross evidence tampering by wrongly they handled the very boxes they used as a pretext to make this bogus case,” Trump said, adding that these “illegal actions by politicized persecutors” should ensure that the entire witch hunt is called off immediately.
