The European Commission is suing the Czech Republic for not having yet transposed the directive on assessing the adequacy of professional laws into its law. The Commission decided to turn to the Court of Justice of the European Union because, even after repeated calls, the Czech Republic did not fulfill its obligations arising from the regulation approved six years ago. It was announced by the Union executive on Wednesday. If the Czech authorities do not comply with the commission’s request even during the court proceedings, the court can impose a fine on Prague.

The standard, adopted by the European Union in 2018, requires Member State authorities to assess whether new rules for the exercise of regulated professions are necessary and proportionate before adopting them. There are dozens of professions that are governed by special regulations in the Czech Republic, from teachers to doctors to car mechanics.

“The Czech Republic did not ensure that all measures covered by the directive, especially if they are initiated by professional associations or parliamentary amendments, were assessed in advance for their adequacy,” the commission stated in today’s justification of its move.

According to the commission, the Czech authorities also did not ensure a sufficient assessment of the impact that the introduction of several new regulatory measures at the same time has on the given professions.
