The appeals panel stiffened the man’s original eight-year sentence. He reclassified his act from grievous bodily harm to attempted murder. The man apologized for the crime at the trial. He stated that he did not mean to kill anyone.
“It was a completely liquidating attack,” said Jiří Lněnička, chairman of the appeals panel of the Prague High Court. According to the verdict, Holický beat his colleague with his fists, but also with a French club. The attacked man was unconscious for a long time, suffered a severe brain injury, multiple facial injuries, had a broken rib, a punctured chest, developed pneumonia, had severe kidney dysfunction, was hypothermic and had other injuries.
The State Attorney’s Office initially charged Holický with attempted murder. He was threatened with up to twenty years behind bars. However, the court of first instance concluded in February that Holický only vented his anger. Then he was at a loss and didn’t know what to do. Apparently, he was counting on the fact that the attacked person would wake up later and the situation would be resolved. According to the court, it was not proven that Holický really wanted to kill the man.
The public prosecutor’s office appealed against the re-evaluation of the act by the Liberec regional court as serious bodily harm. According to the prosecutor Petra Pazderková, the man attacked an acquaintance in a very brutal way out of revenge. The injuries threatened his life and the victim would not have survived without the help of the police and paramedics. According to the prosecutor, Holický himself did not help the man in any way after the crime.
And the appeals panel supported her version. In addition to the brutal attack, he blamed Holické for the following day when he did not provide help to an acquaintance. If the policemen who were looking for the man had not reached the cottage, he would most certainly be dead in the following hours.
Holický beat up an acquaintance after learning that the man was to take over the bar, which he had previously run himself. He lured him to his cottage, which was under construction at the time. He kept him there for about 27 hours. The attacked man remembers almost nothing from it, he still has health consequences to this day.
Holický stated at the trial that he reacted spontaneously. According to his version, the acquaintance came to him voluntarily. The men first argued, then a fight broke out between them. During today’s closing speech, he added that it was because of the money and goods that his colleague had stolen from him. He repeated that he did not want to kill the man.
“I didn’t even think about it. I just wanted to sort out the financial stuff,” he said. According to him, the acquaintance also refused to take him home or to see a doctor.
